New agreements between the social partners of the nautical industry

The unions of employees and managers of companies in the French nautical industry have signed two new agreements on the use of night work, 2 or 3 shift work, and the use of permanent employment contracts.

New stage of social negotiations in the yachting industry

The signing of agreements between employers and unions continues in the nautical sector. After bitter negotiations and several failures in the 2000s, the FCE-CFDT and CFE CGC for the employees and the Federation of Nautical Industries (FIN) for the managers had validated together in October 2020 a new collective agreement for the yachting sector . In order to finalize the text, the social partners had at the time left out some delicate issues. After having sealed a branch agreement in January 2021 on long-term partial activity In March 2021, they validated an agreement on night work and shift work, and a second on the site contract. More easily revised than the collective agreement, these agreements nevertheless give better visibility to employees and employers in the sector who use these activities.

A framework for the use of night work and 3 shifts in the nautical industry

The partners have signed two separate texts called :

  • Agreement on night work, shift work and substitute work in the nautical industry and services
  • Agreement on open-ended employment contracts for construction sites or operations in the nautical industry and services.

The texts provide for minimum hourly and financial compensation for night work and shift work (corresponding to 2/8 or 3/8 shifts). In particular, it is emphasized that night work is exceptional.

The first agreement, already valid for FIN members, will be extended to the whole sector after extension by the Ministry of Labour, while the second will only come into force for all companies after extension.
